Licence and conditions of use of the API (Interface of Programming of Applications of resultados-Futbol.com
1. Definitions
- “API” means the Application Programming Interface of RF.
- “KEY” means the unique identifier provided by RF to each user authorised to use the API.
- "RF” means resultados-Futbol.com.
- “API Client of RF” means any software, like a website or application, of a user, which uses, either directly or indirectly, the API in any way.
- “API RF Specifications” means all information and documentation which RF provides in relation to the API.
- “Brand elements RF” means the commercial names, brands, logos, domain names and other distinctive signings of RF.
- “Results RF” means the database of RF, which contains all the results and statistics which have been incorporated into RF.
- “User” means a user of RF.
- “Website RF” means any and all of the websites controlled by RF with the domain name “RF”.
2. Description of the API of RF
2.1 The API
The API application allows, as a general rule, an API Client of RF to look at the RF Results and show them.
2.2 Obtain access to the API
(a) To obtain access to the API, you must: (i) be a user of RF; and (ii) request an API key at www.resultados-futbol.com/api.
In the request, the user must describe the uses he/she wants to make of the API and provide valid contact details, through which he/she will receive any notification relative to this license. The user promises to provide the information which is mandatory on the form and it also be true, complete and updated. If the user provides, or RF has reason to suspect that he/she has provided false, out of date or incomplete information, RF could suspend or terminate the user’s registration.
If RF gives the user access to one of the APIs, the user will be given a key which will give him/her access to the API.
(b) RF reserves the right, at its own discretion, to reject any request for the use of the API of RF at any moment and for any reason. Consequently, RF are not forced to accept the request of access to the API and will not be responsible for their decision of rejecting any request of access to the API.
3. Licensed uses and restrictions
3.1 Licence of the API.
The API and the API Specifications (the “Licensed Material” are property and ownership exclusively of RF. If you have provided the user a key, RF gives the user a worldwide non-exclusive licence, which cannot be sublicensed, is non-transferable and revocable, to use the licensed materials. It can only be used for the purposes and uses requested by the user and which have been accepted by RF, and under the present conditions.
These conditions define the permitted use of the Licensed Materials, and all of the updates, reviews, substitutions and copies of the Licensed Materiales made by or for the user. The conditions of this licence regulate any update provided by RF which replaces or complements the original Licensed Materials, unless said update is accompanied by a separate licence, in which case the conditions of that licence will apply.
RF reserves all rights relating to the Materials that are not expressly granted to the user in this Licence.
If RF has provided the key under certain conditions or the User and RF have agreed to particular conditions for the use of the Licensed Materials, those conditions will prevail over these conditions.
3.2 General Conditions of the License .
All users of the Licensed Materials accept the following:
- (a) The user must have a valid and active username on RF and if must not have been terminated or suspended by RF, according to what was agreed in RF’s Terms and Conditions.
- (b)The user accepts that he/she is responsible for his/her actions and for the content used while he/she uses the Licensed Materials and for any consequence it leads to. Likewise, the user promises to use the Licensed Materials only for legal and suitable means and in compliance with these conditions and any other policy or instructions of RF. If it is an international user, the user must comply with his/her local laws with regards to online behaviour and acceptable content, including the laws which regulate the exportation of data from the United States to his/her country of residence.
The user promises to not use the Licensed Materials in a negligent manner, with fraudulent means or with the aim of breaking the law or any rights of third parties. In addition, the user promises not to carry out conduct which could damage the image, interests and rights of RF or third parties.
- (c) The user will abstain from supplanting another user or person or carry out any act which affects the API, its security or which interferes with it. Any access and use of the API which is contrary to its normal exploitation and which unjustifiably damages the RF is prohibited, without prior authorisation from RF.
- (d) The user admits that the Licensed Materials are property of RF and of its licensees and are protected by intellectual property law. The user promises to make his/her best efforts to protect their work to make sure they cannot be copied, distributed, shown or altered. The user must make sure that the ownership of the Licensed Materials by RF is visible on every piece of work and is shown on the API Client of RF.
- (e) The user must make sure the key is only used by him/herself in the API Client of RF, based on what has been requested and that it is not shown with third parties. The user must look after the key, treat it as confidential and not reveal it to other people. You must not allow other users access to the Licensed Materials with the key nor should you use the key of another user. The user is responsible for what he/she does with the key via any device. If the user suspects that someone is using his/her key, he must inform RF immediately. RF will be able to suspend or cancel his/her key if it considers that the current licence has failed to be fulfilled or if it suspects that access not authorized by the key has been gained.
- (f) The user must not try to hide or falsify his/her identity or the identity of his/her API Client of RF when he/she asks for authorisation to use the API or at any other moment.
- (g) The user must not use the Licensed Materials to develop a Client API of RF which leads to, promotes or is used in connection with spyware, adware or other programmes or malicious codes.
- (h) The user must not use the Licensed Materials in any way or for any purpose which breaks any law or regulation, infringes any right of any person, including without limitation, intellectual and industrial property rights, intimacy, honour and own image, or personality rights.
- (i) The user must not use the Licensed Materials in a way which impacts, interferes with or disrupts the RF Website, RF’s servers or any element belonging to RF or using an unreasonable amount of broadband. RF reserves the right, at any moment, to limit, as it considers appropriate, the number of requests sent by you via the API.
- (j) The user will not sell, let or sublicense or, in any way, dispose of the Licensed Materials or the key.
- (k) The user must not use in any way any RF Brand element which implies a link, approval, affiliation, sponsorship, guarantee, certification or recommendation by RF or which can be reasonably interpreted as authorised by RF or to suggest editorial content or representing the point of view or opinion of RF.
The user must insert the following phrase in his/her API Client of RF: “This product uses the API of resultados-Futbol.com, but it is not approved, recommended or sponsored by RF and (His/her name( is not linked to or related to RF."
- (l) The user must not save in cache or store any work or other data obtained via the API, apart for reasonable periods of time which must always be temporary.
- (m) The user’s API Client of RF must not contain or transmit any virus, worms, Trojan Horses or any other code with malicious, disruptive or destructive behaviours.
- (n) The user must not use the API to show comparisons between RF and its competitors in any aspect, or to promote goods or services of any of RF’s competitors.
- (o) The resale of the Licensed Materials to third parties is strictly prohibited. RF reserves the right to take the legal actions it deems appropriate in order to compensate for the damage this situation could cause.
4. Responsibility.
The user admits and accepts that he/she always uses the Licensed Materials at his/her own risk and responsibility. Therefore, RF is not responsible for the improper use or use contrary to this licence which could occur.
In accordance with current laws, the Licensed Materials are providing “as is” and “as available” with all their faults and without warranty of any type and RF rejects any warranty with regards to the Licensed Materials, whether they are expressed, implicit or legal, including without limitation, guarantees of merchantability, absence of infringement of third party rights of rights of third parties, satisfactory quality or validity for a specific purpose.
RF does not guarantee the availability and continuity of the functioning of the API, or its reliability, accuracy or its correctness or usefulness for a specific purpose or activity. In accordance with current laws, RF is not responsible for the damage or harm of all types that could occur from everything mentioned previously.
By way of example, but not limited to the following, RF is not responsible for any damage that may arise from:
- (i) Interruptions, viruses, breakdowns, interferences, omissions or disconnections of the electronic system, the communication system or its equipment devices for reasons not connected to RF.
- (ii) Delays or blockages in the use of the API because of deficiencies or overloads on the internet, on the lines or in the electrical or communication systems.
- (iii) Acts of third parties.
- (iv) The inability to access the API because of maintenance work or updates.
- (v) Cualquier otro supuesto fuera del control de RF.
It is the user’s responsibility to have the licences he/she may need to distribute and publish with his/her API Client of RF data, names, club crests or any type of content which is protected by intellectual, industrial or any other type of rights.
5. Intellectual and Industrial Property
All intellectual and industrial property rights on Licensed Materials and the RF Brand Elements belong to or are licensed to RF. The user is only authorised to use the Licensed Materials for the uses determined by this Licence. Unless it has been expressly authorised, any other use of the Licensed Materials is strictly prohibited.
6. Modification or termination
This licence can be terminated by RF or the user at any moment. The user’s rights under this licence will automatically end without warning if the user fails to fulfill any of the conditions. When the licence is terminated, the user will stop using all of the Licensed Material and will destroy all copies, total or partial, of them.
RF will be able to, in any moment, and without incurring any responsibility, vary the content of the Licensed Materials, vary or interrupt their functioning, total or partially, or deactivate or remove all or some of the keys without any limitation other than those established by the applicable laws on the obligation to keep records of certain operations during the corresponding legal periods.
7. Applicable law and jurisdiction
The present Licence will be governed by Spanish law, and any dispute, controversy or conflict with regards to the interpretation or use of it, will be subjected to the courts in Málaga, excluding any other jurisdiction that may correspond to the parties, which they renounce at this moment.
